NOTICE OF PUBLIC HEARING
Shake Shack Drive Thru Signage - Variance

Application and Project Description: On April 13, 2023, Matt Wilson with Chandler Signs on behalf of Shake Shack applied for a variance associated with sign permit SIGN-033443-2023 to reduce the required 50-foot setback of LMC 21.16.320(D) of two drive-thru menu signs from the public right-of-way along Alderwood Mall Parkway by 6.9 feet at the south sign and 2.3 feet at the north sign. The property is zoned Planned Regional Commercial. The application was deemed complete on May 2, 2023.
Location: The property is located at 18800 Alderwood Mall Parkway, Lynnwood, WA (Parcel Number00695200000102). Located to the southeast corner of the Alderwood Mall site east of Macy’s.
Variance Approval: This is a variance request subject to Chapter 21.26 of the Lynnwood Municipal Code (LMC). The application is subject to Process I of Chapter 1.35 LMC. A decision will be made by the hearing examiner following a public hearing.
Hybrid Public Hearing: A hybrid Public Hearing before the Lynnwood Hearing Examiner will be held in person at the Lynnwood Civic Center, Council Chambers at 19100 44th Ave. W, Lynnwood, AND on Zoom at 10:00 AM on June 14, 2023.

Appeal of Hearing Examiner Decision: The only persons who may appeal the Hearing Examiner Decision are persons who: Appear and give testimony at the public hearing; or submitted written comments to the Development and Business Services department during the comment period; or provide written testimony either at or before the public hearing; or signs the register of parties of record at the Public Hearing. Only comments and testimony received at or prior to the Hearing may be considered at the Hearing, or at any Appeal proceeding.
