Public Land Use Notices

Below are notices and announcements for active land use permit applications, code amendments, comprehensive plan amendments, and environmental reviews. The application review process includes opportunities for public comment and, in some instances, appeal.

As part of the land use permit review process, community members are invited to comment on the proposal. For most permit processes with a formal comment period, property owners and occupants within 300 feet of a proposal are sent a notice in the mail. Other types of public notice may include posting at official locations such as City Hall, publication in the Everett Herald, and a public notice sign at the subject property.

All comments must be submitted in writing to the Project Planner by the end of the comment period. People who provide input typically become a Party of Record, and receive future notifications associated with that land use permit.

NOTICE OF APPLICATION: Maple Park Cold Weather Shelter (TNT-010118-2023)

Date of this Notice: February 7, 2024

Description: On October 2, 2023, Chris Eck submitted a Temporary Use Permit application for the establishment of an Extreme Weather Shelter at Maple Park Lutheran Church. The application proposes using existing spaces within the Maple Park Church (17620 60th Ave W) as an Extreme Weather Shelter when the temperature is predicted to drop below 34 degrees Fahrenheit.  Volunteers provide meals and an all-night fire watch is proposed for the building. The shelter will be open for occupants between the hours of 7 pm and 7 am. Wednesdays are late access with the shelter opening at 9 pm and closing at 7 am.

NOTICE IS HEREBY GIVEN that the City of Lynnwood SEPA Responsible Official has issued a Determination of Significance (DS) for the following proposal.

 

Project Description: A new subarea plan is being developed for the City Center + Alderwood Regional Growth Center that will address land use, housing, economic development, transportation, parks and open space, and other topics. The Plan will be consistent with the Growth Management Act, Puget Sound Regional Council Vision 2050 Plan, and Snohomish County Countywide Planning Policies (CPPs). To support implementation of the subarea plan, the City of Lynnwood will prepare Planned Action Ordinance under RCW 43.21C.440 and associated SEPA Rules in WAC 197-11, which will require a Planned Action EIS. Future proposals consistent with the Planned Action Ordinance (and related level of analysis in the EIS), the subarea plan, and development regulations would be subject to a streamlined environmental review process.

 

Location: The Lynnwood Regional Growth Center is an approximately 764-acre area in the southeastern portion of Lynnwood, located along the I-5 freeway, approximately between the 44th Avenue W exit and the I-5/I-405 interchange. Most of the plan area is on the north side of I-5, and includes Lynnwood City Center, Alderwood Mall, the LINK Light Rail City Center station, and the future West Alderwood station. See map next page.

 

Planned Action Environmental Impact Statement: The City of Lynnwood, as lead agency for this proposal, has determined the need to prepare a new Planned Action EIS for the subarea under RCW 43.21C.440 given that a portion of the subarea is already encompassed with an adopted planned action area and ordinance.  The City intends to adopt a new Planned Action Ordinance consistent with the subarea plan. The lead agency has identified the following areas for discussion in the EIS: Land Use Patterns and Socioeconomics, Consistency with Plans and Policies, Multimodal Transportation, Utilities (Including Water, Sewer, and Surface Water Management), and Public Services (Schools, Parks, Police, Fire/Emergency Services, Library, City Services.

 

Alternatives: The City will evaluate a no action alternative (that assumes no changes to current plans, policies, regulations, or zoning) and two action alternatives.  The two action alternatives will include one that analyzes more concentrated growth in the Regional Growth Center (RGC) and one that analyzes more dispersed growth in the RGC, Highway 99 Corridor, and College District.

 

Scoping: Agencies, affected tribes, and members of the public are invited to comment on the scope of the EIS. You may comment on alternatives and/or concerns about potential impacts and make suggestions about potential mitigation measures, as well as other approvals that may be required. Per WAC 197-11-408 and RCW 43.21C.440(3)(b) the City invites the public, agencies, and tribes to a community meeting to discuss the planned action EIS scoping.

 

Appeal Process: This Determination of Significance may be appealed subject to the procedures identified in Lynnwood Municipal Code (LMC) 17.02.195.  Any aggrieved person may appeal this Threshold Determination. An appeal must be filed in writing with the appropriate filing fee within 14 days of the date of determination becoming final. Any appeal must be submitted no later than September 20, 2023.                      

 

The public, interested agency representatives, and tribes are invited to attend a public meeting during the scoping period on Tuesday, September 12, 2023, from 5:00 pm to 7:00 pm at Lynnwood City Council Chambers, 19100 44th Avenue W., Lynnwood, Washington. On August 18, 2023, the Lynnwood Hearing Examiner GRANTED the request of SCAN Design on behalf of Countryside Apartments LLC, to rezone (reclassify) the northern portion of an approximately 3.02 acre property from the Multiple Residential Medium Density (RMM) to the Alderwood-City Center Transition area (ACCT) zone. There are no conditions applied to the request.

 

 

Appeal: Appeals must be received by Thursday, September 7.  Only those persons who participated in the hearing or provided written comments in accordance with LMC 1.35.333 may appeal the decision.

Notice of Appeal Hearing: Appeal of Director’s Interpretation regarding classification of off-campus emergency department (OCED).

 

Application and Project Description: Josh Friedmann, representing MultiCare Health System, submitted an appeal to the Director Interpretation (INT-010043-2023) regarding the classification of an Off-Campus Emergency Department (OCED) in the PCD zone.  

 

Circumstances of Appeal: The City of Lynnwood Development & Business Services Director denied the interpretation request for the OCED to be permitted in the PCD zone. This interpretation was based on the licensing of the OCED, providing inpatient care (at times), providing care which may require overnight stays, and the OCED closely aligned with the term ‘hospital’ (a use that is not permitted in PCD).  

The following provision(s) of the Lynnwood Municipal Code which are the subject of the appeal:  

LMC 21.04.300 – Interpretation of the Zoning Code 

LMC 21.02 – Definitions 

LMC 21.46 – Commercial Zones 

 

Statement of Appeal: The appellant cites the reason for the appeal is that the Decision is erroneous not only because it relies on an improper comparison of the proposed OCED to a full-service hospital, but also because it neglects to conduct the interpretive analysis legally required under the Code

Appeal of Hearing Examiner’s Decision: Only the appellant or the applicable department director may request reconsideration by the Hearing Examiner or appeal the Hearing Examiner’s decision to Superior Court. The request for reconsideration must be filed within seven (7) calendar days of the date of the Hearing Examiner’s decision and does not alter the appeal period for filing with Superior Court unless the reconsideration request is granted. An appeal to Superior Court must be filed within twenty-one (21) days from the date of the Hearing Examiner’s decision is issued. The date of issue is three days after mailing.
