Public Land Use Notices

Below are notices and announcements for active land use permit applications, code amendments, comprehensive plan amendments, and environmental reviews. The application review process includes opportunities for public comment and, in some instances, appeal.

As part of the land use permit review process, community members are invited to comment on the proposal. For most permit processes with a formal comment period, property owners and occupants within 300 feet of a proposal are sent a notice in the mail. Other types of public notice may include posting at official locations such as City Hall, publication in the Everett Herald, and a public notice sign at the subject property.

All comments must be submitted in writing to the Project Planner by the end of the comment period. People who provide input typically become a Party of Record, and receive future notifications associated with that land use permit.

Proposal: Spruce Elementary Portable (File No. PDR-25-0004) 

Project Description: On May 13, 2025, Edmonds School District completed their application for the proposed development of a modular classroom building at Spruce Elementary School. The proposed classroom structure will be located on the upper field directly south of the main building. The proposed modular structure is approximately 1,784 square feet and less than 16’-0” in height. The existing field beneath the structure will be removed and prepared for the placement of the modular building.

City of Lynnwood Notice of Availability: Draft EIS for City Center + Alderwood Subarea Plan

This Notice of Availability is given pursuant to the Washington State Environmental Policy Act (SEPA), RCW 43.21C, and WAC Chapter 197-11 (SEPA Guidelines). This Notice is to advise you that the City of Lynnwood, as lead agency, has issued the Draft Environmental Impact Statement (DEIS) for the City Center + Alderwood (CC+A) Subarea Plan and it is now available for public review.

Project Description: A new subarea plan is being developed for the City Center + Alderwood Regional Growth Center that will address land use, housing, economic development, transportation, parks and open space, and other topics. The Plan will be consistent with the Growth Management Act, Puget Sound Regional Council Vision 2050 Plan, and Snohomish County Countywide Planning Policies (CPPs). To support implementation of the subarea plan, the City of Lynnwood will prepare Planned Action Ordinance at a later date under RCW 43.21C.440 and associated SEPA Rules in WAC 197-11, which will require a Planned Action EIS. Future proposals consistent with the Planned Action Ordinance (and related level of analysis in the EIS), the subarea plan, and development regulations would be subject to a streamlined environmental review process.

Location: The CC+A subarea is an approximately 772-acre area in the southeastern portion of Lynnwood, located along the I-5 freeway, approximately between the 44th Avenue W. exit and the I-5/I-405 interchange. Most of the plan area is on the north side of I-5, and includes Lynnwood City Center, Alderwood mall, the LINK Light Rail City Center station, and the future West Alderwood station.

Public Meeting: The public, interested agency representatives, and tribes are invited to attend a public meeting on Thursday May 8, 2025, from 5:00 p.m. to 6:30 p.m. at the Lynnwood City Council Chambers, 19100 44th Avenue W., Lynnwood, WA 98036.

Public Comment: Those interested in reviewing and commenting the Draft EIS, may access the document and background materials at https://www.lynnwoodwa.gov/publicnotices. Project Description: On April 10, 2025, Kiddie Academy completed their application for a proposed development of a two-story Kiddie Academy childhood education center. The first floor will consist of 6,360 SF and the second floor will be 6,570 SF. The property is currently an undeveloped grass lot with a paved parking lot and the site is zoned HMU (Highway 99 Mixed-Use). Relevant construction improvements to the 0.75-acre site include all associated utilities, stormwater management, right-of-way improvements, and landscaping.

Decision: On Monday June 16, 2025, the City of Lynnwood’s Hearing Examiner granted approval for the Edmonds School District to place a 1,001 sq. ft. modular medical structure at Meadowdale High School. The medical structure will be located in the northeast portion of the subject site, just north of the existing portable classrooms. The purpose of the medical facility is to expand the school-based health program that aims to increase access to preventative, early intervention, and behavioral health services by school affiliated behavioral health providers for enrolled public-school students. Decision: On June 16, 2025, the City of Lynnwood’s Hearing Examiner issued a decision for the ‘Packard 2025 Variances’. The variance applications sought relief from the minimum lot width and front setback requirements of the Lynnwood Municipal Code. The decision granted approval for the variance from the requirement for minimum lot width. The proposed projects include construction of three new single-family houses (one on each lot listed below), grading, and associated utility work. DETERMINATION OF NONSIGNIFICANCE

City of Lynnwood Code Amendment: Unified Development Code Update (CAM-25-0002)

NOTICE IS HEREBY GIVEN that the City of Lynnwood SEPA Responsible Official has issued a Determination of Non-significance (DNS) for the following proposal:

Project Description: On April 24, 2025, the City of Lynnwood Development & Business Services Department, on behalf of the City of Lynnwood, submitted a SEPA checklist for the adoption of a Unified Development Code (UDC). The UDC is intended to update and consolidate Title 18 Planning, Title 19 Subdivisions, and Title 21 Zoning, into a single Title 8 Unified Development Code. Title 8 will also incorporate portions of 1.35 Application Processing and Review, as well as the City’s various Design Guidelines.

If the City does not implement revisions for middle housing and accessory dwelling units, Lynnwood will need to adopt a Model Code developed by the Washington State Department of Commerce. Location: City-wide

Comments and Appeals: This DNS is issued under WAC 197-11-340 (2)(c); as the lead agency, City of Lynnwood will not act on this proposal for 14 days from the date of issuance. The comment period ends May 8, 2025, and the DNS will become final unless the determination is withdrawn or amended by the City’s SEPA Responsible Official.

Any aggrieved person may appeal this threshold determination by submitting an appeal in writing to: Development & Business Services, 20816 44th Ave W, Suite 230, Lynnwood, WA 98036. An appeal may be submitted only after the close of the comment period but no later than May 22, 2025, which is 14 days from the end of the comment period. Be prepared to make specific factual objections. The fee for an appeal is set forth in LMC 3.104.

- Chapter 8.90 Administration and Permit Processing, per WAC 197-11-800(19)(a)

Comprehensive Plan Amendments

City of Lynnwood 2025 Amendments to the Comprehensive Plan

NOTICE IS HEREBY GIVEN that:

The City of Lynnwood is now accepting requests to consider amendments to the City of Lynnwood Comprehensive Plan (“Plan”). This opportunity will occur with the required periodic update. By state law, amendments to the Plan generally may be considered only once a year. Lynnwood’s Comprehensive Plan is the official public policy document to guide the City’s growth and development over the coming years.

Adopted by the City Council, the Plan contains text, statistics, and maps that are available for use by both the public and private sectors of Lynnwood. The Plan may be viewed on the City’s website (www.lynnwoodwa.gov). The deadline for filing for the 2025 amendment cycle is April 1, 2025.

2023 Annual Amendment Process

By state law, amendments to the Plan generally may be considered only once a year. The deadline for filing for the 2023 amendment cycle is March 31, 2023.

NOTICE OF PUBLIC HEARINGS – City of Lynnwood Code Amendment: Unified Development Code Update (CAM-25-0002)

Notice: The City of Lynnwood Planning Commission and City Council will conduct individual public hearings on the below-referenced project. Interested community members are invited to attend this public hearing and to provide comments, either orally or in writing.

Project Description: A proposal to adopt a Unified Development Code (UDC). The UDC is intended to update and consolidate Title 18 Planning, Title 19 Subdivisions, and Title 21 Zoning, and the City’s various Design Guidelines into a new title: Title 8 Unified Development Code. The UDC update includes updates to Title 1.35 Application Processing and Review, Title 3.104 Fees and Charges, and Title 9.18 Fire Sprinkler Requirements. If the City of Lynnwood does not implement revisions for middle housing and accessory dwelling units, the City is required to adopt the Model Code developed by the Washington State Department of Commerce.

Project Description: The City of Lynnwood is proposing adoption of the Draft Commute Trip Reduction Plan for 2025-2029, as well as a code amendment to amend by replacement LMC Chapter 11.14 “Commute Trip Reduction Plan” and adopt a new LMC Chapter 11.15 “Commuter Benefit Ordinance”.

Location: This is a Citywide Non-Project Action.
