Application and Project Description: On February 2, 2023, Sam Huck (3J-Consulting), on behalf of the subject property owners, applied to rezone (reclassify) approximately 3.73 acres, of which contains two separate lots, from the Highway 99 Mixed Use (HMU) to General Commercial (CG) zone. The Comprehensive Plan Future Land Use designation of the properties is Highway 99 Corridor. The application was deemed complete July 6, 2023.

Approval Required: This is a site-specific rezone subject to Chapter 21.22 of the Lynnwood Municipal Code (LMC). The application is subject to Process I of Chapter 1.35 LMC. A decision will be made by the hearing examiner following a public hearing.

Appeal of Hearing Examiner Decision: The only persons who may appeal the Hearing Examiner Decision are persons who:
- Appear and give testimony at the public hearing; or
- Submitted written comments to the Community Development Department during the comment period; or
- Provide written testimony either at or before the public hearing; or
- Signs the register of parties of record at the Public Hearing.
Only comments and testimony received at or prior to the Hearing may be considered at the Hearing, or at any Appeal proceeding.
