NOTICE OF APPLICATION & OPTIONAL DNS PROCESS

Proposal: 44th Ave W/I-5 Underpass Pedestrian and Bicycle Improvement (SEPA-25-0001).

Project Description: On February 5, 2025, Kevin Corrigan, Otak, on behalf of the City of Lynnwood, submitted a SEPA review checklist for the 44th Ave W/I-5 Underpass Pedestrian and Bicycle Improvement Project. The City of Lynnwood plans to construct a bicycle and pedestrian path on the east side of 44th Avenue W, and will include improved drainage, lighting, architectural and artistic design elements, and ADA compliance to provide a safe and connected network for pedestrians and bicyclists. The application was deemed complete on February 5, 2025.

Location: The project is located at the I-5 crossing of 44th Avenue West. Project limits run on 44th Avenue West from approximately 200th St SW to 204th St SW/I-5 North off-ramp.

Required Approvals: This project requires the approval of a SEPA permit, Critical Areas Permit, and other government issued permits including but not limited to: WDFW Hydraulic Project Approval (HPA), NEPA Categorical Exclusion Documentation, USACE Section 404 Nationwide Permit and Ecology 401 Water Quality Certificate, National Historic Preservation Act Section 106 Approval, Section 7 ESA Compliance Documentation, National Magnusson-Stevens Fishery Conservation Management Act (MSA).

SEPA Review: The City of Lynnwood has reviewed the proposed project for probable adverse environmental impacts and expects to issue a Determination of Nonsignificance (DNS). This determination is based on the following findings and conclusions: Project is designed to avoid and minimize impacts to wetlands, streams, and buffers to the maximum extent while meeting project goals. Sidewalk will be widened to the west towards the vehicle travel lanes as much as possible to further minimize impact. All temporary wetland impacts will be restored following construction. Unavoidable impacts to wetlands and streams will follow mitigation sequencing under Title 17 LMC, Credits are to be purchased in a wetland mitigation bank for these unavoidable impacts due to site constraints that prevent on-site mitigation.

The optional DNS process of WAC 197-11-355 is being used. This may be your only opportunity to comment on the environmental impact of the proposed project. The proposal may include mitigation measures under applicable codes, and the project review process may incorporate or require mitigation measures regardless of whether an EIS is prepared. A copy of the subsequent threshold determination for the specific proposal may be obtained upon request.

Only those who provide written comments may appeal the decision.
