Public Land Use Notices

Below are notices and announcements for active land use permit applications, code amendments, comprehensive plan amendments, and environmental reviews. The application review process includes opportunities for public comment and, in some instances, appeal.

As part of the land use permit review process, community members are invited to comment on the proposal. For most permit processes with a formal comment period, property owners and occupants within 300 feet of a proposal are sent a notice in the mail. Other types of public notice may include posting at official locations such as City Hall, publication in the Everett Herald, and a public notice sign at the subject property.

All comments must be submitted in writing to the Project Planner by the end of the comment period. People who provide input typically become a Party of Record, and receive future notifications associated with that land use permit.

Notice of Application: Shake Shack Drive Thru Signage Variance (File No. VAR-010064-2023)

 

Application and Project Description: On April 13, 2023, Matt Wilson with Chandler Signs on behalf of Shake Shack applied for a variance associated with sign permit SIGN-033443-2023 to reduce the required 50-foot setback of LMC 21.16.320(D) of two drive-thru menu signs from the public right-of-way along Alderwood Mall Parkway by 6.9 feet at the south sign and 2.3 feet at the north sign. KOZ at Alderwood Project Design Review – Off-Site Parking Location

Application and Project Description:

 On March 15, 2022, Jagira Hane of Koz Development, submitted applications for Project Design Review (PDR) and Environmental Review (SEPA) for the development of a 199-unit, 7-story multi-family residential building with 100 parking spaces in the City Center-Core (CC-C) zone. Notice of Appeal Hearing: Appeal of Director’s Interpretation regarding classification of off-campus emergency department (OCED).

 

Application and Project Description: Josh Friedmann, representing MultiCare Health System, submitted an appeal to the Director Interpretation (INT-010043-2023) regarding the classification of an Off-Campus Emergency Department (OCED) in the PCD zone.  

 

Circumstances of Appeal: The City of Lynnwood Development & Business Services Director denied the interpretation request for the OCED to be permitted in the PCD zone. This interpretation was based on the licensing of the OCED, providing inpatient care (at times), providing care which may require overnight stays, and the OCED closely aligned with the term ‘hospital’ (a use that is not permitted in PCD).  

The following provision(s) of the Lynnwood Municipal Code which are the subject of the appeal:  

LMC 21.04.300 – Interpretation of the Zoning Code 

LMC 21.02 – Definitions 

LMC 21.46 – Commercial Zones 

 

Statement of Appeal: The appellant cites the reason for the appeal is that the Decision is erroneous not only because it relies on an improper comparison of the proposed OCED to a full-service hospital, but also because it neglects to conduct the interpretive analysis legally required under the Code
