Public Land Use Notices

Below are notices and announcements for active land use permit applications, code amendments, comprehensive plan amendments, and environmental reviews. The application review process includes opportunities for public comment and, in some instances, appeal.

As part of the land use permit review process, community members are invited to comment on the proposal. For most permit processes with a formal comment period, property owners and occupants within 300 feet of a proposal are sent a notice in the mail. Other types of public notice may include posting at official locations such as City Hall, publication in the Everett Herald, and a public notice sign at the subject property.

All comments must be submitted in writing to the Project Planner by the end of the comment period. People who provide input typically become a Party of Record, and receive future notifications associated with that land use permit.

Land Use Permit Applications Under Review (including SEPA)

NOTICE OF APPLICATION AND OPTIONAL MDNS PROCESS

Proposal: Polaris at Lynnwood (File no. PDR-26-0002 SEPA-26-0005)

Project Description: On April 24, 2026 and May 6, 2026, Andrew Bernard of Inland Construction, on behalf of Northview Center SPE LLC submitted Project Development Review (PDR) and SEPA applications for plans for a mixed use affordable multifamily apartment with commercial space. The building will be 6 stories over 2 levels of below grade parking garage, with 294 units, 305 parking stalls, 7,500 sf of indoor amenity space and leasing office, approximately 18,000 sf of courtyard amenity space, and 1,300 sf of commercial space. The PDR and SEPA applications were deemed complete on May 29, 2026.

Required Permits: This project requires the approval of PDR, SEPA, and Critical Areas Permit (CAP) permits, as well as associated construction permits.

SEPA Review: The City of Lynnwood has reviewed the proposed project for probable adverse environmental impacts and expects to issue a Mitigated Determination of Nonsignificance MDNS. This determination is based on the following findings and conclusions: 1. A preliminary critical areas report identifies a proposed mitigation plan which was designed in accordance with applicable policies and guidance, showing all proposed mitigation being based on best available science and demonstrating no net loss of critical area functions and values. 2. Lift Station No. 14 can be reasonably modified to increase capacity consistent with the demand of the proposed development. 3. Previous environmental review of the City Center + Alderwood Regional Growth Center included a Draft Environmental Impact Statement and Final Environmental Impact Statement which reviewed potential adverse environmental impacts to demographics, land use patterns and housing; community design and aesthetics; natural and built environment; multimodal transportation and related greenhouse gas emissions; public services (fire and police protection, parks, and schools); utilities (water, sewer, and stormwater); and relationship to plans and policies. Based on these findings and conclusions, the City anticipates including the following conditions of the MDNS: 1. A critical areas permit (CAP) is to be applied for and approved prior to Project Development Review issuance. 2.Installation of new pumps and confirmation of adequate capacity, or a contingency bypass pumping plan able to maintain adequate capacity in the event that upgrades are not yet completed must be in place for Lift Station No. 14 prior to Certificate of Occupancy.

Staff reviewed submitted materials including a site plan, critical areas report, and SEPA checklist. The optional MDNS process of WAC 197-11-355 is being used. This may be the only opportunity to comment on the environmental impact of the proposed project. The proposal may include mitigation measures under applicable codes, and the project review process may incorporate or require mitigation measures regardless of whether an EIS is prepared. A copy of the subsequent threshold determination for the specific proposal may be obtained upon request.

NOTICE IS HEREBY GIVEN that the City of Lynnwood SEPA Responsible Official has issued a Mitigated Determination of Non-significance (MDNS) for the following proposal:

Project Description: On January 29, 2026, Johnny Vong of Blackfish Capital, on behalf of submitted an application for a SEPA for a proposal (PDR-25-0009) for 175-unit multi-family affordable housing development which was deemed complete on December 5, 2025. The proposed construction includes a 7-story apartment of 141,416 gross square feet with 54 surface parking stalls located under the structure.

This plan’s goal is to identify and recommend a 10- year and 20-year Capital Improvement Plan (CIP) for the City of Lynnwood’s water system. The plan evaluates existing system conditions, projected water demand, regulatory requirements, and infrastructure needs in order to guide long term investment in reliable, efficient, and sustainable water service. Projects described within this plan will be evaluated for SEPA applicability at the time of application.

Decision: On May 13, 2025, the City of Lynnwood’s Development & Business Services Director granted approval with conditions for proposed construction of a 58,764 square foot, three story, mixed-use building. The proposed building will contain 34 apartment units. On-site parking will include 39 new parking stalls for residents and commercial spaces. The first floor will contain 1,901 square feet of commercial space. On site landscaping, lighting, and plazas will also be provided. This project also recorded an approved boundary line adjustment, combining a small undevelopable lot to the south under permit number BLA-26-0001.

Proposal: The School Project Reasonable Use Exception (CAP-25-0006)

Decision: On April 27, 2026, the City of Lynnwood’s Hearing Examiner issued a decision for ‘The School Project Reasonable Use Exception’. The applicant, Rajesh Vasireddy sought a Reasonable Use Exception from the provisions of Chapter 17.10 Lynnwood Municipal Code Environmentally Sensitive Areas, to reduce a stream buffer width from 100 feet to 50 feet. Comprehensive Plan Amendments

City of Lynnwood 2026 Amendments to the Comprehensive Plan

Notice is hereby given that the City of Lynnwood is now accepting requests to consider amendments to the City of Lynnwood Comprehensive Plan (CPL). This opportunity will occur concurrently with the required periodic update. Per LMC 8.90.0400(C)(1)(a), proposals for amendments must be considered by the City Council no more frequently than once every calendar year. Lynnwood’s Comprehensive Plan is the official public policy document to guide the City’s growth and development over the coming years.

Lynnwood’s Comprehensive Plan is adopted by the City Council, and contains text, statistics, and maps that are available for use by both the public and private sectors within the City. The full Comprehensive Plan document may be viewed on the City’s website at: www.lynnwoodwa.gov by searching “Comprehensive Plan”. The deadline for filing for any amendment suggestions and applications for the 2026 CPL Amendment cycle is 5:00 pm April 1, 2026.

Hearing Examiner Public Hearings

NOTICE OF PUBLIC OPEN HOUSE

Snohomish County Hazard Mitigation Plan- Lynnwood Annex Plan Open House

The Community Planning Division will hold a public open house on Wednesday, April 29, from 5:00-7:00pm for the 2025 Lynnwood Annex to Snohomish County’s Hazard Mitigation Plan (HMP). The open house will include posters, a rotating slide presentation, and a feedback collection activity. Those interested in the City’s Hazard Mitigation Planning efforts are invited to participate and learn more about the planning process and the Draft HMP Annex Plan.

Project Description: The City of Lynnwood is drafting an Annex Planning Document to support Snohomish County’s Hazard Mitigation Plan. This document supports funding for hazard mitigation projects and works together with other City long-range plans to help the City mitigate against both human-made and natural hazard events. Council adoption of the annex plan will occur after review by Snohomish County and FEMA.

Location: This is a Citywide Non-Project Action.

Public Open House Time and Location: The open house will be held in-person at City Hall (19100 44th Ave. W, Lynnwood, WA 98036) in Council Chambers from 5:00-7:00pm on April 29, 2026.

NOTICE OF PUBLIC HEARING

Proposal: The School Project Reasonable Use Exception (CAP-25-0007)

Notice: The City of Lynnwood’s Hearing Examiner will conduct a public hearing on April 22, at 9:00 AM, at which the request described below will be considered. Interested community members are invited to attend this public hearing and to provide comments, either orally or in writing.

Description: On November 6, 2025, Rajesh Vasireddy, on behalf of Garudachalam, LLC, submitted a critical areas permit for use of site that includes a stream buffer. On January 12, 2026, the applicant was notified that a reasonable use exception is required. On February 23, 2026, the applicant submitted the revised critical area report and reasonable use exception request. The reasonable use exception request requires approval of the Lynnwood Hearing Examiner from per LMC 17.10.046(A). The application is subject to Process I of LMC Chapter 1.35.100-180.

Lynnwood Mobile Food Vendor Code Update (CAM-26-0001)

The Lynnwood Planning Commission and City Council will conduct individual public hearings on the above referenced code amendment. Interested community members are invited to attend these public hearings and to provide comments, either orally or in writing.

Project Description: The City of Lynnwood is proposing changes to Title 8, Unified Development Code regarding Mobile Food Vendors to improve code clarity, provide updated processes, and update general food vendor regulations. Changes to Title 8 include updating the 8.35 Use Tables to permit food vendors, adding code from LMC 5.18 Mobile Food Vendors to the Food and Beverage limitations sections to create a mobile food vendor permit, repealing LMC 5.18, and updating 8.99.0250 Definitions to include updated mobile food vendor definitions.

Location: This is a Citywide Non-Project Action.
