Public Land Use Notices

Below are notices and announcements for active land use permit applications, code amendments, comprehensive plan amendments, and environmental reviews. The application review process includes opportunities for public comment and, in some instances, appeal.

As part of the land use permit review process, community members are invited to comment on the proposal. For most permit processes with a formal comment period, property owners and occupants within 300 feet of a proposal are sent a notice in the mail. Other types of public notice may include posting at official locations such as City Hall, publication in the Everett Herald, and a public notice sign at the subject property.

All comments must be submitted in writing to the Project Planner by the end of the comment period. People who provide input typically become a Party of Record, and receive future notifications associated with that land use permit.

Land Use Permit Applications Under Review (including SEPA)

NOTICE OF APPLICATION AND OPTIONAL DNS PROCESS

Proposal: HASCO 200th St Development (PDR-26-0001, SEPA-26-0003, BLA-26-0002)

Project Description: On February 24 and 25, 2026, Emily Darling of SMR Architects, on behalf of Housing Authority of Snohomish County (HASCO) submitted PDR and SEPA applications for plans for a proposed affordable housing development (124 units) comprised of two buildings. Both proposed buildings are four stories of wood framed construction, located to limit impact to the existing tree canopy. Building A is designed with larger units for families (64 units), and Building B will serve seniors (60 units). The PDR application and SEPA application were deemed complete on March 6, 2026.

Required Permits: This project requires the approval of a PDR, SEPA, and BLA permit, as well as associated construction permits.

SEPA Review: The City of Lynnwood has reviewed the proposed project for probable adverse environmental impacts and expects to issue a Determination of Nonsignificance (DNS). This determination is based on the following findings and conclusions:

The proposed use of the site is similar to the use previously on the site and is a permitted use within the zone. It has been determined that the project does not have a probable significant adverse impact on the environment. Staff reviewed submitted materials including a site plan and SEPA checklist. The optional DNS process of WAC 197-11-355 is being used. This may be your only opportunity to comment on the environmental impact of the proposed project. The proposal may include mitigation measures under applicable codes, and the project review process may incorporate or require mitigation measures regardless of whether an EIS is prepared. A copy of the subsequent threshold determination for the specific proposal may be obtained upon request.

Comments and Contact: Any person has the right to comment on this project. Comments concerning this project should be made in writing and delivered to the City of Lynnwood Development & Business Services Department office. Only those who provide written comments may appeal the decision. Those who may wish to receive notice of and participate in any hearings, and/or request a copy of the decision once made and any appeal rights may also submit such requests to the Development & Business Services Department.

Project Description: On February 20, 2026, Kevin Biggs of North by Northwest Surveying submitted an application for the Raitt Short Plat. The application proposes to divide one Residential Neighborhood zoned lot into two lots. The application was deemed complete on March 2, 2026.

Land Use Permit Decisions & SEPA Determinations

DETERMINATION OF NONSIGNIFICANCE

City of Lynnwood Code Amendment: Interim Paid Parking Ordinance (CAM-26-0008)

NOTICE IS HEREBY GIVEN that the City of Lynnwood SEPA Responsible Official has issued a Determination of Non-significance (DNS) for the following proposal:

Project Description: On March 25, 2026, the City of Lynnwood Development & Business Services Department, on behalf of the City of Lynnwood, submitted a SEPA checklist for the adoption of an interim paid parking ordinance. The proposal seeks to allow for paid surface parking as an allowed use on an interim basis for a period of 6 months. The proposal is a citywide non project action and does not seek to construct new parking areas.

Location: City-wide

Comments and Appeals: This DNS is issued under WAC 197-11-340; as the lead agency, City of Lynnwood will not act on this proposal for 14 days from the date of issuance. Any person, affected tribe, or agency may submit comments to the lead agency within 14 days of the date of issuance of the DNS. The comment period ends April 10, 2026, and the DNS will become final unless the determination is withdrawn or amended by the City’s SEPA Responsible Official.

Any person, affected tribe, or agency may appeal this threshold determination by submitting an appeal in writing to: Development & Business Services, 19100 44th Ave W, Lynnwood, WA 98036. An appeal may be submitted only after the close of the comment period but no later than April 24, 2026, which is 14 days from the end of the comment period. Be prepared to make specific factual objections. The fee for an appeal is set forth in LMC 3.104.

Decision: On March 25, 2026, the City of Lynnwood’s Development & Business Services Director granted approval with conditions for a Preliminary Short Plat to create two new lots and two tracts by subdividing an approximately 28,318 square foot parcel. The existing 28,318 square foot lot will be separated into three lots: Lot 1, measuring 6,013 square feet, Lot 2, measuring 6,219 square feet, and Lot 3 measuring 7,752 square feet. NOTICE OF DECISION

Proposal Name and File Number: New Middle School at former Alderwood Middle School (PDR-25-0007)

Decision: On February 25, 2026, the City of Lynnwood’s Development & Business Services Director granted approval with conditions for a proposed construction of a new 145,439 gross square foot, 2-story middle school, new bus loop and parking area, playfields, utility infrastructure, walkways and landscaping. A new access from Alderwood Mall Parkway is proposed and applied for under DE-25-0017. The new middle school will serve grades 6-8, with a capacity designed for 800 students with a capacity of up to 1,000.  Critical areas permit (CAP-25-0005) has been submitted and approved for this project to address critical areas and associated buffers on the site. Edmonds School District acted as the Lead Agency for a SEPA Determination of Nonsignificance regarding this project. Comprehensive Plan Amendments

City of Lynnwood 2026 Amendments to the Comprehensive Plan

Notice is hereby given that the City of Lynnwood is now accepting requests to consider amendments to the City of Lynnwood Comprehensive Plan (CPL). This opportunity will occur concurrently with the required periodic update. Per LMC 8.90.0400(C)(1)(a), proposals for amendments must be considered by the City Council no more frequently than once every calendar year. Lynnwood’s Comprehensive Plan is the official public policy document to guide the City’s growth and development over the coming years.

Lynnwood’s Comprehensive Plan is adopted by the City Council, and contains text, statistics, and maps that are available for use by both the public and private sectors within the City. The full Comprehensive Plan document may be viewed on the City’s website at: www.lynnwoodwa.gov by searching “Comprehensive Plan”. The deadline for filing for any amendment suggestions and applications for the 2026 CPL Amendment cycle is 5:00 pm April 1, 2026.

Proposal: The School Project Reasonable Use Exception (CAP-25-0007)

Notice: The City of Lynnwood’s Hearing Examiner will conduct a public hearing on April 22, at 9:00 AM, at which the request described below will be considered. Interested community members are invited to attend this public hearing and to provide comments, either orally or in writing.

Description: On November 6, 2025, Rajesh Vasireddy, on behalf of Garudachalam, LLC, submitted a critical areas permit for use of site that includes a stream buffer. On January 12, 2026, the applicant was notified that a reasonable use exception is required. On February 23, 2026, the applicant submitted the revised critical area report and reasonable use exception request. The reasonable use exception request requires approval of the Lynnwood Hearing Examiner from per LMC 17.10.046(A). The application is subject to Process I of LMC Chapter 1.35.100-180.

Lynnwood Mobile Food Vendor Code Update (CAM-26-0001)

Project Description: The City of Lynnwood is proposing changes to Title 8, Unified Development Code regarding Mobile Food Vendors to improve code clarity, provide updated processes, and update general food vendor regulations. Changes to Title 8 include updating the 8.35 Use Tables to permit food vendors, adding code from LMC 5.18 Mobile Food Vendors to the Food and Beverage limitations sections to create a mobile food vendor permit, repealing LMC 5.18, and updating 8.99.0250 Definitions to include updated mobile food vendor definitions.
